Terms and Conditions

The Hirer agrees that all charges for hire, loss, damage, and repairs will be paid in full. The Hirer is also responsible for any collection fees, legal fees, court costs, or other expenses incurred in the recovery of these charges.

If the play centre is set up inside a home, we are not responsible for any damage caused.

If you cancel your booking after your deposit has been paid, the deposit is non-refundable. If you cancel your booking within 7 days of the booking date, 100% of the hire fee is payable.

Damage to Equipment

The Hirer is responsible for any loss or damage to the equipment for any reason, except for reasonable wear and tear.

At the end of the hire period, the Hirer agrees to cover the full cost of repair or replacement of any damaged or lost equipment.

Damage to Property or Person

The Hirer is responsible for any loss or damage to property or injury to persons caused by the equipment during the hire period.

The Hirer agrees to indemnify the Owner against all claims, damages, and expenses arising from such incidents.

Period of Hire

The hire period begins on the commencement date specified or at the time the equipment is delivered to the Hirer (whichever is later).

The hire period ends when the equipment is collected by our staff.

Hiring Charges

Hiring charges apply from the start of the hire period and continue until the equipment is collected, in accordance with the agreed rates.

Breakdown

In the event of equipment breakdown or failure, the Hirer must not attempt to repair the equipment without prior consent from the Owner.

If the breakdown is due to reasonable wear and tear (and not misuse or negligence), the hire period adjustment will be determined by the Owner.

The Owner is not liable for any loss, damage, or expenses incurred by the Hirer due to equipment failure, regardless of cause.

Termination by the Owner

The Owner may terminate this agreement and repossess the equipment immediately if:

  • The Hirer fails to pay hiring charges upon delivery;
  • The Hirer acts in a way that may prejudice the Owner’s rights to the equipment;
  • The Hirer becomes insolvent, bankrupt, or enters into an arrangement with creditors;
  • The Hirer (if a company) enters liquidation;
  • The Hirer breaches any part of this agreement.

The Owner may enter any premises to recover the equipment without liability and without affecting the Owner’s right to recover outstanding monies or damages.

The Hirer indemnifies the Owner against any claims, damages, or expenses arising from such actions.

Assignment

This agreement may not be transferred or assigned to any other party without the prior written consent of the Owner.
